Dear Sirs/Madams,

The Portuguese Government has recently published the Decree-Law No. 119-A/2021, from December 22nd, extending, once more, the validity of the official documents, namely visas, concerning the entry and permanence in Portuguese territory.

Under the above-mentioned legislation the residence permit cards whose validity expired on or after February 24th, 2020 shall be valid, for all legal purposes, until March 31st, 2022.

In addition, such documents shall continue to be accepted, under the same terms, after 31st March 2022, provided that the holder proves that he/she has already scheduled the respective renewal.

IAS would point out that this extension is exclusively recognized by the Portuguese authorities, meaning that the holders of an expired Portuguese Residence Permit, extended as per the aforementioned legislation, that does not hold a short-term visitor’s Visa or a valid Schengen Visa, is solely able to enter the Schengen Area directly via Portugal.

This amendment to the current regulation has an important impact in protecting the rights of foreign citizens who are effectively prevented from travelling to Portugal or from making appointments at the Foreigners and Borders Service (SEF). Nevertheless, IAS advises its represented investors and ARI holders, who are not effectively and justifiably prevented from travelling, to make all necessary arrangements and attend the appointment for renewal of their residence permit.
